Cypress LeadSource is a service of Cypress Video LLC (“Cypress,” “we,” “our,” or “us”). By purchasing or using our audience data services (“Services”), you agree to the following Terms of Service. Please read them carefully before using our Services.
1. Services Provided
Cypress LeadSource provides custom marketing audience lists (“Audience Data”) for clients. These lists are sourced, curated, and delivered either by direct sync to your advertising accounts (such as Meta, Google, or other platforms) or, in certain cases, by file transfer.
2. Payment & Guarantee
Payment Requirement: All fees for Services must be paid in full before Cypress begins work.
Money-Back Guarantee: We offer a 14-day satisfaction guarantee. If you are not satisfied with your Audience Data within 14 days of delivery/sync, you may request a full refund.
3. Permitted Use
You may use Audience Data solely for your own business’s advertising, marketing, and analytics purposes.
You may not:
Resell, redistribute, lease, or sublicense your custom Audience Data to third parties.
Represent Audience Data as your own proprietary product or “white-label” it.
Use Audience Data in connection with credit, insurance, employment, or other eligibility determinations regulated by law.
Use Audience Data for unlawful, deceptive, or misleading advertising, or in violation of platform advertising policies.
4. Privacy & Compliance
Cypress LeadSource provides data in compliance with applicable privacy laws, including (where applicable) the California Consumer Privacy Act (CCPA), the General Data Protection Regulation (GDPR), and industry self-regulatory standards (DAA, IAB, NAI).
You agree to use Audience Data in compliance with:
All applicable laws and regulations governing digital marketing, data usage, and consumer privacy.
The policies of any advertising platforms on which you use the data.
5. Confidentiality
Any non-public information exchanged between you and Cypress (including custom data, methodologies, or business information) is considered confidential. Both parties agree not to disclose such information to unauthorized third parties.
6. Termination
Either party may terminate Services for any reason with written notice. Upon termination, you must discontinue use of any Audience Data provided. Refunds are only available under the 14-day money-back guarantee.
7. Disclaimers
Cypress LeadSource provides Audience Data without warranties of accuracy, completeness, or fitness for a particular purpose. Results may vary depending on your campaigns, creative, and strategy.
8. Limitation of Liability
To the maximum extent permitted by law:
Cypress will not be liable for indirect, incidental, or consequential damages arising from the use of our Services.
Cypress’s total liability shall not exceed the total fees paid by you for the Services giving rise to the claim.
9. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Florida.
10. Updates
We may update these Terms of Service from time to time. Continued use of our Services after changes take effect constitutes your acceptance of the updated Terms.
